1. INTRODUCTION AND RULE OF CONTRACTING

The present Terms & Conditions (hereinafter referred to as T&C) represent the General Conditions of Contracting of the on line services provided by HOME AROUND INTERNATIONAL SL, with legal address at c/ Caspe 46, 5º H, 08010 Barcelona, NIF B65548695, hereinafter referred to as OUR COMPANY; to the USER, with scope and conditions as set hereinafter. The USER declares that all the data and information provided is correct and knows and accepts the totality of the following T&C.

2. PERSONAL DATA

The personal data provided by the USER is confidential and protected. OUR COMPANY informs USER that all levels of security of protection of personal data legally required have been adopted and all possible technical measures to prevent the loss, improper use, alteration, unauthorized access and copy of the personal data provided have been installed. However, the USER shall recognize that although all the measures are taken, Internet security cannot be fully granted. In no case, the personal user data will be used for a different purpose than that described in these T&C. The USER has the right to access, cancel, rectify and reject the use of personal data by written communication sent to OUR COMPANY. In no case the personal user data will be released to third parties without written permission from the USER.

3.PURPOSE

These T&C have the purpose to set the conditions based on which OUR COMPANY supplies the service or the services that the USER accepts without limitation.These T&C may be complemented by specific conditions related to a product or service. The fulfillment of an on line Request Form and its acceptance, imply the acceptance without any restriction or limitation of these T&C.

4.SERVICES

The USER may contract one or more services described at www.homearound.com. Said services will be ruled by these T&C and by any other specific conditions that may be applicable. USER fully understands that some or all the services described and offered in www.homearound.com are not provided by OUR COMPANY and therefore will claim no liabilities or damages to OUR COMPANY as set in the following clause.

5.RESPONSIBILITY

A. - Of the Service supplier:

OUR COMPANY will be not responsible for the direct or indirect damage of any nature caused by:

  1. Altering the privacy and security in the use of the contents of the website and the services offered by unknown third parties, according to the current legal regime.
  2. The presence of fake elements in the services offered by third parties through the Web page that may alter the computer system, electronic documents or files of the USER.
  3. The lack of truthfulness, accuracy, completeness and timeliness of the content offered by third parties.
  4. The lack of legality, reliability or usefulness of the contents of the services offered by third parties through the website.

B. - Of the USER

The USER is solely and exclusively responsible for its identification when accessing the service and for the use of the webpage and its related services.

6. DURATION AND TERMINATION

The service of the website has no terminatiomn date. Nevertheless, OUR COMPANY is entitled to terminate or suspend the service of the website and / or any of the services therein offered at any time, without disregarding any provisions relevant as set in these T&C. When reasonably possible, OUR COMPANY will release a prior notice of the termination or suspension of the service provided by the Web page

SPECIFIC CONDITIONS APPLIED TO BOOKING SERVICES

7. DESCRIPTION OF THE SERVICE

OUR COMPANY publishes on line the proposals of accommodation on behalf of owners and provides an informative service to the USER. OUR COMPANY allows USER to access the owner’s contact details such as name and exact address of the accommodation, when the downpayment has been paid by USER and after verifying that USER request is compliant with these T&C or any other conditions as set in the accommodation's description.

8. ACCEPTANCE OF THE BOOKING REQUEST AND FINAL CONFIRMATION

OUR COMPANY uses all means available to ensure that the online availability calendar of each accommodation is updated. However, OUR COMPANY cannot guarantee that at the time of processing the Reservation Request, the proposed accommodation is still available. OUR COMPANY reserves the right to reject the reservation request of the USER and propose alternative solutions, if any. OUR COMPANY shall not be held liable for any consequence derived from a reservation being rejected.

After receiving the reservation request from the user, OUR COMPANY will verify the compliance of said request to these T&C and will inform of said request to the accommodation owner. OUR COMPANY will confirm the reservation only if accepted by the owner. If owner does not accept, OUR COMPANY will inform the USER. If owner accepts the reservation, OUR COMPANY will charge the services to USER.
A reservation is only confirmed after payment by USER has been received by OUR COMPANY. Once a resevation is confirmed, USER will receive a confirmation from OUR COMPANY with the owner's contact information, the exact address of the accommodation and other relevant information that may be applicable.

USER acknowledges and accepts that confirmed reservations are subject to these T&C and the terms and conditions specified in the rental agreements listed in this page for each location.

9. RATES

All rates are VAT included.

  1. The total booking includes utilities consumption costs (gas, electricity and water) up to a max. of € 120 (Euros) per month and rental contract/booking.
  2. The total booking does not include utilities consumption cost (such as gas, electricity and water) for rental contracts of more than one month. These costs shall be separately billed and USER must pay them directly to the owner. If the duration of the rental contract is for less than a month, these costs are included.
  3. In any case the total price does not include telephone expenses. Such expenses will be billed separately and the USER shall pay the telephone charges.
  4. Internet services may be charged separately or be ncluded in the rate. Please refer to the accommodation description.

10. PAYMENTS

Payment terms are described in each accommodation proposal and are divided into:

  1. Downpayment: USER must pay Downpayment to OUR COMPANY in order for the reservation to be confirmed.
  2. Balance: paid on arrival by USER to owner.
  3. Security Deposit: this is paid by USER to owner upon check-in, and is refunded on check-out provided no damages have been caused to the accommodation.

Downpayment may be paid via PayPal, credit card, or bank transfer. Balance and Security Deposit must be paid by USER to onwer in cash. Only where dully specified may Balance and Security Deposit be paid by other means of payment.

11. CANCELLATION BY THE USER

USER may cancel a confirmed reservation by sending an email to OUR COMPANY informing on the request of cancellation. The written communication is mandatory for the validity of the cancellation. The date of receipt of the email is the effective date of cancellation of the booking.

If USER cancels a confirmed reservation OUR COMPANY will apply the following penalties:

  1. If cancellation is made with more than 30 (thirty) days from the date of arrival, OUR COMPANY will refund the amount paid by USER minus an administration fee of 90 (Ninety) Euros.
  2. Cancellation Terms: - within 30 days prior to the arrival day we will charge the 40% of the total amount to the Credit Card. - within 15 days prior to the arrival day we will charge the 80% of the total amount to the Credit Card. - within 2 days prior to the arrival day or No Show we will charge the 100% of the total amount.

12. CANCELLATION BY OUR COMPANY

OUR COMPANY may cancel a booking due to: acts of the owner, "force majeure" or any other reason, with prior written notice to the USER. In case of cancellation by OUR COMPANY, OUR COMPANY will reimburse the USER 100% (hundred percent) of all amounts paid by USER for the booking. OUR COMPANY will not be liable for any damages, losses, and / or costs, that arise, directly or indirectly, from the cancellation.

13. LATE CHECK-IN

Unless otherwise stated in each property's description, a late check-in has the following surcharge added to the booking total to be paid upon check-in by USER: 35 Euros for check-in between 20:00 and 23:00. 50 Euros for check-in between 23:00 and 8:00.

14. SECURITY DEPOSIT

USER must pay a security deposit to the owner when checking in to ensure good care of the accommodation, its furniture and accessories. This security deposit will be refunded to USER on check-out, provided no damage has been made.

15. USE OF ACCOMMODATION

Individuals and business travelers must use the accommodation as a holiday stay. In no case will the property be used, and USER has no permission to do so, for commercial purposes. In no instance will the accommodation be understoood as legal residence of USER.

16. STATE AND MAINTENANCE OF ACCOMMODATION

The USER must keep and maintain the property in good conditions throughout and until the end of the booking, and USER to pay OUR COMPANY or the owner the current market prices in case of damage or loss of properties/accommodation caused by USER or any other person occupying the accommodation.

17. RULES OF BEHAVIOR

USER and all other persons included in the booking shall abide by the following accommodation rules, and USER is responsible of ensuring that persons traveling in his/her party respect such rules. Non compliance of these rules will grant the owner and/or OUR COMPANY the right to ask to leave the accommodation, with no right by USER to claim and compensation.

18. ACCOMMODATION RULES

  1. Respect your neighbors and keep the noise to a minimum inside the accommodation, but also in other areas (staircase, garden, etc.). If there are compalints from neighbors due to noise or disruptive behavior, USER will be asked to leave the accommodation with no right to refund or compensation.
  2. Smoking is not allowed in the properties.

19. ASSIGNMENT OF THE RESERVATION

All bookings are personal and assigned to a specific USER, and therefore, may not be totally or partially transferred to any other person.

20. COMPENSATION

Owner cannot be held responsible for damage or injuries suffered by USER and/or other people and/or personal belonging, caused by equipment and/or structure of the apartment and/or services supplied in the apartment.

21. TERMINATION

Termination by USER of a booking ahead of time doesn't entitle USER to any compensation or refund.
